Welcome to Nexora Custom Designs. These Terms of Service (“Terms”) govern your use of our website, online store, products, content, and related services (collectively, the “Services”).

By using our Services or placing an order, you agree to these Terms, our Privacy Policy, and our Return & Refund Policy. If you do not agree, please do not use the Services.

1. Our Store and Fulfillment

Nexora Custom Designs operates this online store, which is powered by Shopify.

Our products feature designs and creative content provided by Nexora Custom Designs. Products may be produced, printed, packaged, and fulfilled through Printify and one or more third-party production or fulfillment providers.

The provider used for an order may vary depending on the product, destination, availability, and fulfillment requirements.

Although third-party providers may manufacture and fulfill products, purchases made through our store are purchases from Nexora Custom Designs.

2. Products and Customization

We make reasonable efforts to display product information, images, colors, sizes, and designs accurately. Actual colors and appearance may vary depending on your device, display settings, materials, and manufacturing processes.

Product availability, specifications, and designs may change where permitted by law.

For personalized products, you are responsible for providing accurate names, text, dates, images, and other customization information and for reviewing your order before submission.

3. Orders and Cancellations

Submitting an order constitutes a request to purchase the selected product.

We may decline or cancel an order where reasonably necessary, including because of availability, pricing or listing errors, payment issues, suspected fraud, shipping restrictions, or other legitimate reasons.

Because many products may enter production after an order is placed, cancellation may not be possible once production has started.

If we cancel an order after payment, any applicable refund will be processed in accordance with our Return & Refund Policy and applicable law.

4. Prices and Payment

Prices shown at the time of purchase apply to your order unless an error is identified.

Shipping charges, taxes, customs duties, import charges, or other applicable charges may apply depending on the destination and applicable law.

Payments are processed through Shopify and/or applicable payment providers.

You agree to provide accurate billing and payment information and to use an authorized payment method.

5. Shipping and Delivery

Orders are produced and fulfilled through Printify and applicable production, fulfillment, and shipping providers.

Estimated delivery times are not guaranteed and may be affected by production times, carrier delays, customs, weather, holidays, destination restrictions, or other circumstances beyond our reasonable control.

We will work with the applicable fulfillment or shipping provider to investigate and resolve the issue in accordance with our policies and applicable law.

Nothing in these Terms limits any mandatory consumer rights relating to delivery or loss of goods.

6. Returns, Refunds and Consumer Rights

Returns, refunds, cancellations, replacements, and applicable exchanges are governed by our Return & Refund Policy.

Nothing in these Terms excludes or limits mandatory consumer rights that cannot legally be excluded or limited.

Where applicable, customers may have statutory rights relating to withdrawal, defective or damaged products, incorrect products, or products that do not conform to the applicable contract.

Personalized or made-to-order products may qualify for applicable legal exceptions to cancellation or withdrawal rights, but such exceptions do not remove mandatory rights relating to defective, damaged, incorrect, or non-conforming products.

7. Intellectual Property

Nexora Custom Designs owns or has the necessary rights to the original designs, artwork, photographs, graphics, branding, text, and other creative content made available through the Services.

Purchasing a product does not transfer ownership of the underlying intellectual-property rights.

You may not copy, reproduce, distribute, modify, resell, commercially exploit, or otherwise use our protected content without our prior written permission, except where permitted by applicable law.

8. Customer-Provided Content

If you provide text, photographs, artwork, images, or other content for personalization, you represent that you have the necessary rights and permissions to use that content.

You remain responsible for the content you provide.

We and our applicable service providers may use such content only as reasonably necessary to process, manufacture, fulfill, deliver, support, and administer your order and as otherwise permitted by applicable law.

9. Third-Party Services

We use third-party services and providers, including Shopify, Printify, payment processors, production and fulfillment providers, shipping carriers, analytics services, and other technology providers.

These providers may process information or perform services necessary to operate our store and fulfill your orders.

Third-party services may also have their own terms and privacy policies.

10. Shopify

Our online store is hosted and powered by Shopify.

Shopify provides the technology and infrastructure that enables us to operate our store and process online transactions.

Shopify is not the seller of products purchased from Nexora Custom Designs.

Shopify's handling of personal information is described in the applicable Shopify privacy documentation and our Privacy Policy.

You agree to use the Services only for lawful purposes.
